What is garage keepers legal liability insurance?

Garage keepers legal liability is the default basis of garage keepers coverage. The insurer pays for damage to a customer’s vehicle in your care, custody, or control only when you are legally liable for it. ISO’s Garagekeepers Coverage endorsement writes it that way unless the Excess or Primary box is marked on the schedule.

The practical consequence is that the claim turns on fault. What you can show about the car’s condition and your handling of it is part of the coverage question, not paperwork around it.

It is the default basis of garage keepers coverage: the insurer pays for damage to a customer's vehicle in your care, custody, or control only when you are legally liable for it. ISO's Garagekeepers Coverage endorsement CA 99 37 10 01 pays all sums the insured legally must pay as damages for loss to a customer's auto left in the insured's care, and it stays on that legal liability basis unless the EXCESS INSURANCE or PRIMARY INSURANCE box is marked on the schedule. Carriers and brokers often abbreviate it GKLL.

It pays when the shop is legally liable, which in practice means negligence, and it can be denied when the insurer decides the shop was not at fault. Intrepid Direct's explainer gives the common example: a theft claim can be refused outright if the insurer concludes security was adequate. Direct Primary pays regardless of fault, and Direct Excess pays after the owner's own policy responds, so neither turns on that finding in the same way. The form's own exclusions apply to all three, including theft or conversion caused by you or your employees and faulty work you performed.

Read the schedule to the Garagekeepers Coverage endorsement. On the ISO form, the direct options are printed as checkboxes, and if neither EXCESS INSURANCE nor PRIMARY INSURANCE is marked, the endorsement pays only when you are legally liable. The limit and premium must also appear on the schedule for the coverage type and the location, because coverage is not automatic at every site. Confirm the form with your agent or insurer; this is general information, not legal or insurance advice.

Because the coverage trigger is whether you were legally liable, so what you can show about the car's condition and your handling of it is part of the claim rather than paperwork around it. Intrepid Direct states that thorough intake documentation helps establish what damage was pre-existing, which is critical when coverage depends on negligence. A record is context for the insurer; it does not establish fault or guarantee that a loss is covered.
